Most Magnolia jobs begin with a survey and a pencil line. Somebody bought a piece off the end of a larger parcel — five acres, twelve, twenty-five — and what they hold today is trees, a fence corner and a frontage number.
Turning that into buildable ground is four problems in a fixed order: get a drive in, find the high dry part, shape a pad on it, and leave the rest of the timber standing. Around here that sequence is the work, far more often than a one-shot lot cleanup.
What makes land around Magnolia different
Large tracts are still being cut into small ones. Southwest Montgomery County held its big parcels longer than the I-45 side did, and it is spending them now. FM 1488 runs from US 290 east of Hempstead northeast through town toward Conroe; FM 1774 comes down from Anderson through Plantersville, crosses 1488 in the middle of Magnolia, and carries on to FM 149 at Pinehurst. SH 249 added a third axis when its Magnolia-area segments opened in 2020 and 2021. Frontage on any of the three is why a sixty-acre place becomes six pieces instead of staying one.
The country changes along 1488 depending which way you drive. West toward the Waller County line it opens up — pasture, scattered post oak, sandier ground that takes a wet week better. East toward The Woodlands it closes back into second-growth loblolly with a solid yaupon floor. The same ten acres can be two entirely different machine schedules based on nothing but which end of the corridor it sits on.
Lake Creek drains this side of the county on its way east to the West Fork. It and its feeders carry hardwood bottom — sweetgum, water oak, elm — plus Chinese tallow, the region’s most determined resprouter, which returns from a cut stump thicker than it left.
Yaupon holly is what you are actually buying through. Woody, tight, and back off the root crown if a machine cuts it rather than grinding it out. Nobody selling a tract describes it. It is the difference between a plat that says “lightly wooded” and a site that takes three weeks.
Most of the soil is clay, and clay has opinions about the calendar. It holds a rut for a full growing season once heavy equipment tears it saturated. The dependable stretch here runs late fall into early spring, which is also when everyone else wants a crew.
Much of the acreage sits inside restricted communities. Lake Windcrest carries roughly 900 wooded homesites; High Meadow Ranch and the Mostyn Manor area work the same way. In places like those, what limits your cutting is a private covenant recorded against your deed — not a government rule, and frequently stricter than one.
A Magnolia address is usually not the City of Magnolia
The city covers roughly five square miles, with its ETJ reaching about a half mile past that. The city states plainly that the Magnolia mailing address is far larger than the city limits. For scale, Magnolia ISD spans about 150 square miles. Nearly every acreage tract with this address answers to the county.
If you genuinely are inside the limits, the city permits more than people expect. Its published permit list includes a tree removal permit and a site work permit, alongside building, driveway, fence and foundation permits. That is a different rulebook from Conroe’s Chapter 102, and a clearing plan written on county assumptions does not survive inside a city limit. Confirm the parcel with the permit office first.
Outside the limits there is no zoning and no county tree ordinance. The county’s requirements are short and specific — septic through Environmental Health, a floodplain development permit before dirt gets dug, graded or filled in a mapped 100-year flood zone, a development permit covering enclosed structures and any manufactured home being set, and a 911 address for each dwelling. Your driveway depends on whose road you are tying into. Off a county road that is a culvert inspection through your Commissioner’s precinct, and the inspector sizes the pipe and has to see it before it gets covered. Off FM 1488, FM 1774 or FM 149 you are in state right of way, which is a TxDOT access driveway permit instead. Two offices, two lead times, decided by the road rather than the address.
Burning is narrower than the rumor. Beyond any county ban — adopted by Commissioners Court, cited by the Fire Marshal — on unincorporated ground state rules make household refuse burning an offense on a parcel of less than five acres, and equally an offense on any lot in a platted subdivision or touching one inside 300 feet. Either fact alone does it, as a Class C misdemeanor. Between subdivisions and small carve-outs, that covers a great deal of Magnolia.

Common questions
How do I find out whether I’m in the Magnolia city limits? The city keeps an interactive zoning map and its permit office will confirm a parcel by phone or email. A five-square-mile city inside a mailing area this large means most people guess wrong in the same direction, so check before you plan a scope.
I want to split my acreage into three tracts. Does that change the clearing? It changes the sequence more than the machine work. Dividing land generally pulls county subdivision and plat review into the picture, with statutory exemptions that turn on tract size and access. Settle it before the deed is drawn, because your drive locations and your surveyed lines have to agree.
Can I put a driveway straight onto FM 1488? Not without a TxDOT access permit. State right of way is TxDOT’s call on location, width and pipe, and nothing happens inside it until the permit is executed. On a county road it is your precinct instead.
I have fifteen acres. How much should I actually clear? Usually the envelope, the drive and a yard — often two or three acres of the fifteen. Clearing all of it costs more, removes the screen you paid a premium for, and can put a timber or wildlife valuation at risk.
My deed restrictions say I can’t remove trees, but the county has no tree ordinance. Which wins? Both apply, independently. A county with no ordinance does not release you from a covenant recorded against your own title, and out in the acreage communities those are enforced by the association rather than a permit office. Read them before you take a bid.
