Start with the fact that changes every other answer on this page: Pinehurst has no municipal government.
It is a census-designated place — a name and a boundary the Census Bureau draws around a community for statistical purposes. Around eight square miles of southwest Montgomery County, first counted under its own name in 1990, with no mayor, no council, no city hall, no city permits, no city inspector. Precinct 2 of the county is your local government, and that is the entire list.
Every contractor bidding here knows Magnolia is a city. Almost none of them will mention that Pinehurst is not one.
What makes land in Pinehurst different
The road map explains the property. FM 1774 comes down out of Grimes County through Plantersville, crosses FM 1488 at Magnolia, then runs southeast to FM 149 here. SH 249 threads the same ground, and in 2020 part of that alignment was redesignated FM 1774 through the unincorporated stretch. That corridor is why twenty years turned quiet pine acreage into large-lot subdivisions, and why most of what we work on now is a five-acre piece with new neighbors on both sides.
Loblolly over yaupon, with sand through the profile. This corner of the county sits where the piney woods begin thinning toward prairie, and the soil follows — more sand than the heavy clay east of I-45, so the ground takes a wet week better and costs fewer lost days. The trade is at the other end. Sand makes a poor pond bottom. Quote a pond on this side without putting a hand in the dirt and you have quoted a hole that will be dry by August unless it gets a keyed clay core.
The tollway rewrote drainage on parcels near it. New embankment, new ditches, new outfalls. Water that used to leave a tract one way leaves it another, and on some parcels the low corner moved. Walk the property after a real rain before fixing where the pad and the drive go.
Yaupon and privet hold the understory; tallow holds the draws. All three come back off the root if the method only takes the stem. Mulching to adequate depth kills them; a bush hog just prunes them. And anything past roughly eight inches at the trunk is outside a mulching head’s range — on a tract left alone since the last cut, that split is the biggest variable in how long the job runs.
Unincorporated means the county is the whole authority
There is no municipal layer here at all, so everything that would normally sit above the county is simply absent: no city clearing permit, no municipal tree ordinance, no zoning districts, no city inspector, no city engineer reviewing your entrance. The county has no zoning either, so nothing replaces it.
What remains is the county list, and it is short — a development permit where a structure or manufactured home is going in, OSSF authorization through Environmental Health tied to a soil evaluation, floodplain approval before anything is dug, graded or filled inside a mapped 100-year zone, a 911 address, and a culvert permit through Precinct 2. No city hall does not mean no rules. Deed restrictions and HOA architectural committees are private contracts attached to the land, not government, and the absence of a city does nothing to them. Covenants here can be stricter about tree removal than any municipal ordinance in this county, and they are enforced by lawsuit rather than citation. That catches people.
On burning: the state prohibits household refuse burning where a parcel measures under five acres, and prohibits it separately where the ground lies in a platted subdivision or within 300 feet of one. Neither test depends on the other, and failing one is a Class C misdemeanor. Given how much of Pinehurst is platted subdivision now, assume a pile is not the plan — and assume the county burn ban sits on top of that.
Pinehurst is not Magnolia, and the difference is legal
Magnolia incorporated in 1968, covers a little under five square miles at FM 1488 and FM 1774, runs a unified development code, issues its own permits, and carries an extraterritorial jurisdiction past its limits. A project inside those limits answers to a city first.
Pinehurst has none of that. Same pines, same yaupon, same appraisal district — one fewer rulebook.
One thing to confirm rather than assume: whether your parcel falls inside Magnolia’s ETJ, which can reach beyond the city limit and pull development standards with it. Worth a check, because the ETJ line does not follow the city limit sign.

Common questions
Is Pinehurst a city? No. It is a census-designated place with no municipal government of any kind. The county is your only governmental authority, and for roads and culverts that means Commissioner Precinct 2.
Then who do I call for a permit? Montgomery County, by subject — Environmental Health for septic, the permit office for development and floodplain, the precinct for a culvert, county addressing for a 911 number. There is no Pinehurst counter to walk into.
My friend in Magnolia needed a city permit. Do I? Not if your parcel sits outside Magnolia’s limits and outside its ETJ. Pinehurst addresses and Magnolia addresses sit side by side out here and get different answers, which is why we pull the parcel first.
There is no city, so can my HOA still stop me removing a tree? Yes. Deed restrictions are a private contract attached to the land, and they operate whether or not a city exists. Read the covenants before the machine arrives, not after the tree is down.
